Privacy Statement

ChronoPad® is a trade name of JKC Trading B.V. (“ChronoPad®”, “we”, “us”). We respect your privacy and handle your personal data with care, in line with the General Data Protection Regulation (GDPR / AVG) and the Dutch Telecommunications Act. This statement explains which personal data we process when you visit our website or place an order, why we process it, who we share it with, how long we keep it, and which rights you have. It also explains how we use cookies (section 6).

1. Who is responsible for your data (controller)

The controller for your personal data is the company behind ChronoPad®:

We have not appointed a Data Protection Officer. You can reach us with any privacy question at the e-mail address above.

2. Which personal data we process

Depending on how you use our website, we may process the following:

• Identification and contact data: your name, e-mail address and, if you provide it, your telephone number.
• Order and delivery data: your billing and shipping address, order details and order history.
• Account data: if you create an account, your login details (such as your e-mail address and password) and the preferences and order history saved in your account.
• Payment data: your payment method and transaction details. Payments run through our payment provider Mollie, so we do not store full card or bank details ourselves.
• Communication data: the content of e-mails or messages you send us.
• Newsletter data: if you subscribe, your e-mail address and subscription preferences.
• Website and device data: your IP address, browser and device information, and the pages you visit, collected through cookies and similar technologies (see section 6).

3. Why we process your data and on what legal basis

We only process your data where the law allows it. The bases we rely on are:

• Processing and delivering your order and providing customer service. This is necessary to perform our contract with you (Article 6(1)(b) GDPR).
• Handling payments, which is also part of performing our contract with you.
• Creating and managing your customer account, which we do to perform our contract with you and because we have a legitimate interest in offering account features such as saved details and order history (Article 6(1)(b) and (f) GDPR).
• Handling returns, warranty claims and complaints, which follows from our contract with you and from our legal obligations.
• Meeting statutory obligations, such as keeping records for tax purposes (Article 6(1)(c) GDPR).
• Sending our newsletter, which we do only if you have subscribed and given your consent (Article 6(1)(a) GDPR). You can withdraw that consent at any time.
• Securing, maintaining and improving our website and preventing fraud and abuse, which we do on the basis of our legitimate interest (Article 6(1)(f) GDPR).

4. Sharing your data with third parties

We share your personal data only where this is needed for the purposes above or where the law requires it. The main parties we work with are:

• Mollie B.V., which processes our payments;
• PostNL, which ships and delivers your order;
• JKC Media B.V., our affiliated company, which provides our website hosting and IT support;
• Mailchimp (Intuit Inc.), which we use to send our newsletter if you have subscribed;
• our accountant, and government authorities where we are legally required to share data.

Where these parties process personal data on our behalf, they act as processors and we have a data processing agreement (verwerkersovereenkomst) in place with each of them. Under that agreement they may only use your data on our instructions. We never sell your personal data.

Most of these parties process your data inside the European Economic Area (EEA). Mailchimp processes data in the United States. For that transfer we rely on appropriate safeguards, namely the EU-US Data Privacy Framework and the European Commission’s Standard Contractual Clauses.

5. How long we keep your data

We never keep your personal data longer than we need it for the purposes set out above. Order and invoice data are kept for seven years to meet the Dutch tax retention obligation. Newsletter data is kept until you unsubscribe or withdraw your consent. Account data is kept for as long as your account stays active, and you can ask us to close and delete your account at any time. We delete other personal data once we no longer need it.

6. Cookies

Our website uses cookies and similar technologies. A cookie is a small text file that is stored on your device when you visit a website. We use three kinds:

• Strictly necessary cookies: these make the website and the webshop work, including the shopping basket and the payment process through Mollie. They are always placed and do not need your consent.
• Analytical cookies: these help us understand how visitors use our website so we can improve it. We place them only with your consent.
• Marketing cookies: these help us make content and offers more relevant, and may also be set by Mailchimp when you interact with our newsletter or sign-up forms. We place them only with your consent.

When you first visit our website, the cookie banner lets you accept or refuse the analytical and marketing cookies. You can change or withdraw your choice at any time through the cookie settings on our website, and you can delete or block cookies through your browser. If you refuse the non-essential cookies you can still use the webshop, although some features may be less convenient.

7. Your rights

Under the GDPR you can ask to see your personal data and to have it corrected, deleted, restricted or transferred. You can object to processing that we base on our legitimate interest, and where we rely on your consent you can withdraw it at any time without affecting what we did before you withdrew it.

To use any of these rights, e-mail us at info@chronopad.jkc-dev.nl. We will reply within one month, and we may ask you to confirm your identity first so that we protect your privacy.

Complaints: if you feel we are not handling your data properly, you can file a complaint with the Dutch Data Protection Authority, the Autoriteit Persoonsgegevens (autoriteitpersoonsgegevens.nl).

8. Security

We take suitable technical and organisational measures to protect your personal data against loss and misuse, including secured (SSL/TLS) connections and limited access to data. If you think your data is not properly protected, please let us know at info@chronopad.jkc-dev.nl.

9. Children

Our website and products are not aimed at children under the age of 16, and we do not knowingly collect their personal data. If you believe we have, please contact us and we will delete it.

10. Changes to this statement

We may update this privacy statement from time to time, for example when our services or the law change. The latest version is always the one published on this page, with its version number and date.
